Agreement to Terms

By hiring Forgeview Smyrna Landscaping for any services, you agree to these Terms of Service. Please read them carefully before we start work on your property. If you have questions about anything in these terms, contact us before signing any agreements or allowing work to begin. These terms apply to all services we provide, including but not limited to lawn maintenance, landscape design and installation, hardscaping, irrigation, tree services, and seasonal cleanups.

Services and Estimates

We provide free estimates for all services. These estimates are based on the information you provide and our initial assessment of your property. Final costs may vary if we discover unforeseen conditions during the project, such as poor soil quality, hidden drainage issues, or underground utilities. If additional work is needed beyond the original estimate, we will notify you and get your approval before proceeding.

All estimates are valid for 30 days from the date provided. After that time, prices may change based on material costs, labor availability, or other factors. We reserve the right to refuse service to any property or client for any reason.

Payment Terms

For one-time projects, we require a deposit before starting work. The deposit amount will be specified in your estimate or contract. The remaining balance is due upon completion of the project. For ongoing maintenance services, payment is due at the time of service or according to the schedule outlined in your service agreement.

We accept cash, check, and major credit cards. Late payments may incur additional fees. If your account becomes past due, we may pause services until payment is received. We reserve the right to charge interest on overdue balances at the maximum rate allowed by Tennessee law.

If you dispute a charge, please contact us within 10 days of receiving your invoice. We will work with you to resolve any billing issues fairly and promptly.

Cancellations and Rescheduling

If you need to cancel or reschedule a service, please give us at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee. For large projects, cancellation policies will be outlined in your contract.

Weather sometimes forces us to reschedule. If we cannot complete your service on the scheduled day due to rain, extreme heat, or other weather conditions, we will contact you to arrange a new date as soon as possible. No fees apply when we reschedule due to weather.

Property Access and Safety

You are responsible for providing clear access to all areas where we will be working. This includes unlocking gates, moving vehicles, and removing any obstacles that could interfere with our equipment or crew. If we cannot access the property as scheduled, additional fees may apply for return trips.

Please keep pets indoors or secured away from the work area during our visits. For your safety and ours, we ask that you keep children at a safe distance while we are working. Our equipment can be dangerous, and we want everyone to stay safe.

If you have underground utilities, irrigation lines, or other hidden features, please mark or inform us of their locations before we begin. While we take care to avoid damaging underground systems, we are not responsible for damage to unmarked utilities or features you did not disclose to us.

Plant and Material Warranties

We guarantee that all plants installed by us will be healthy and appropriate for your property conditions at the time of installation. However, plant survival depends on many factors beyond our control, including weather, soil conditions, watering, and ongoing care. We offer a 30-day warranty on installed plants, provided you follow our care instructions. This warranty covers replacement of plants that die due to installation issues, not environmental factors or neglect.

Hardscaping materials such as pavers, stone, and concrete are warranted against defects for one year from installation. This warranty does not cover damage from settling, freeze-thaw cycles, vehicle traffic, or improper maintenance. We stand behind our workmanship and will address any installation issues that arise within the warranty period at no additional cost.

Liability and Insurance

We carry full liability insurance and workers compensation coverage. If our crew accidentally damages your property during service, we will repair or replace it at no cost to you. However, we are not responsible for pre-existing damage, unmarked underground utilities, or damage that occurs due to factors outside our control.

Our liability is limited to the cost of the service performed. We are not responsible for indirect damages, lost income, or other consequential losses. If you believe we have damaged your property, please notify us within 48 hours so we can assess and address the issue promptly.

Termination of Service

For ongoing maintenance agreements, either party may terminate the agreement with 30 days written notice. If you terminate mid-season, you will be responsible for payment for all services completed up to the termination date.

We reserve the right to terminate service immediately if you fail to pay invoices on time, behave abusively toward our crew, or violate these terms in any way.

Changes to Terms

We may update these Terms of Service from time to time. Any changes will be posted on our website with a new "Last Updated" date. Continuing to use our services after changes are posted means you accept the updated terms. For significant changes, we will make reasonable efforts to notify existing clients directly.
